Terms and conditions - Broadcasting Agency Ltd

Bookings

No job can proceed without Broadcasting Agency Ltd ("the Agency") receiving a signed Production Company agreement or confirmation email.

All artists introduced by the Agency to the Client or his Agent must be booked through the Agency.

Fees

All fees are to be negotiated with the Agency and only with the Agency.

Overtime rates per hour apply before 7:30 am (Dawn call) at one fifth of daily negotiated rate per hour or part. Overtime rates will apply after 10 hours. Within these times, normal rates negotiated apply.

Overtime is charged at one fifth of the daily rate per hour for any shoot over 10 hours. A special rate is negotiated for evening / night work / Weekends and Bank Holidays. The normal working day is ten hours which includes an hour taken for lunch.

If the artist is not give a meal within 6 hours of call time, there will be a broken lunch charge. 2nd broken meal is 13 hours after call-time.

Meals are to be provided by the Client where the booking / assignment if for a full day or part / half day where this would normally include a lunch break.

Travel / Expenses

An additional travel payment to be negotiated at the time of booking if outside of the London area.

Please note additional fees will be paid to the Agency if the artist is upgraded from Background to Walk-on, or Walk-on to featured.

Cancellations

Full fees will be invoiced if an assignment is cancelled by the Client 24 hours prior to the shoot day.

If a booking / confirmation is cancelled due to illness or any other reason beyond the Model / Artist or the Agency's control neither Broadcasting Agency Ltd nor the Model / Artist shall be liable for cancellation charges to the Client. We will endeavour to our best ability to replace the artist.

Weather Permitting Bookings / Confirmations. At the first cancellation, a half fee will be charged unless the Client fails to cancel in time to prevent the Artist's attendance, when the full fee is payable. If there is a second cancellation the full original negotiated fee will be charged.

Invoicing / Payment

Payment on all invoices is required within 30 days of date of invoice unless specified by the client at the time of the booking.

Any photographs found on the Agency's site are the property of Broadcasting Extras Ltd and are not to be used for commercial or promotional purposes by anyone but the Agency.

Employment

When employing an artist as an SA, walk-on or featured performer, the responsibility for tax and NI relies with the production company (the employer) and not the Agency.

Insurance

It is the Client's responsibility to arrange all insurance and cover needed for any assignment. This includes personal and third party liability insurance at an assignment and indemnity in the event that an Artist is unable to attend for whatever reason.

Please note that the Agency reserves the right to negotiate within the structure of these Terms and Conditions without prejudice to any prior or subsequent negotiation or agreement.

These Terms and Conditions take precedence over any Terms and Conditions that may be received from the Client (even if those Terms and Conditions have a clause similar to this) unless agreed prior to the assignment.

The Client should notify all interested third parties affected by these Terms and Conditions that they apply to the assignment and should be read in conjunction with the Terms contained in the Booking / Confirmation and Invoice.
